Drug Driving Solicitors

If you are charged with driving whilst unfit through drugs currently it is not enough for the police to show that you had taken a drug prior to driving, or that you were in possession of a drug when stopped or even that there was a presence of an illegal drug in your blood.

The prosecution must establish that your ability to drive is properly impaired by the drug. Can the police show that there was bad driving, that the persons condition showed evidence of impairment such as slurred speech, pupils dilated e.t.c; in addition to drugs being present in the persons blood.

The police will often call a Police Doctor who has the accused carry out a series of tests at the police station such as walking in a straight line (heel to toe), touching the tip of your nose with your finger e.t.c with a view to assessing whether the persons condition had been affected by the drug.

The section this offence is charged under and the recommended maximum sentence for driving or attempting to drive whilst unfit through drugs, on conviction, is as follows: -

Section 4(1) Road Traffic Act 1988

36 months disqualification and 6 months imprisonment
