Our solicitor Mr Gary Bryan was instructed by a client who had received a summons for the following offence;
Driving Without Insurance
Client informed us that he had been stopped driving his motor vehicle by a police officer who immediately contacted his insurer. The officer asked the insurer whether they were aware of clients previous ban which had now expired. They confirmed that no such prior ban had been disclosed upon the taking out of the policy and that failure rendered the policy void.
Accordingly the officer immediately seized the car and reported the client for prosecution.
Our Solicitor advised client to enquire with the policy provider the exact date and time that the policy was cancelled. As if the admin to cancel the policy had taken longer than the seizure of the car took then it could be said that client had insurance at the time of having the vehicle on the road.
Sure enough the cancellation date on the policy was 2 or 3 days after date of the offence.
Our Solicitor had the case dismissed on the first appearance in court. Thus 6 to 8 penalty points were avoided. The court granted a defence costs certificate.
